Eligibility for Medicaid in New York is typically determined based upon income, age, health and assets. There are various factors that may affect one's eligibility to receive Medicaid benefits, and it is therefore recommended that you discuss the matter with an experienced legal professional who can advise you of your rights and options. In addition to helping determine your eligibility, a legal representative at our firm can help you with your Medicaid application and in filing an appeal if you are denied.

Rules for Medicaid Eligibility

Following are the eligibility requirements for New York Medicaid for an applicant who is over the age of 65, for 2010. These can be used as a general outline, but how it may affect your particular situation may vary:

  • Annual income of $9,200 (for a single person)
  • Monthly income of $767 (for a single person)
  • $13,800 in total assets (for a single person), excluding one's residence or other exempt property
